General Terms and Conditions (Allgemeine Geschäftsbedingungen)
This is a courtesy translation. In case of discrepancies, the German version prevails. These terms govern the sale of research chemicals via kiluk-peptides.com. All substances offered are intended exclusively for laboratory, educational and research purposes. They are not suitable for human or animal consumption and must not be used for medical, therapeutic, diagnostic or cosmetic purposes. Sold exclusively to persons aged 18 or over for use in laboratory, educational and research settings. By placing your order you confirm that you are aware of this restriction of purpose and that you comply with it. Version: 4 September 2026.
1. Scope and provider
These General Terms and Conditions (Allgemeine Geschäftsbedingungen, AGB) apply to all contracts concluded between the provider and the customer via the online shop at kiluk-peptides.com. The version available in the shop at the time of the order is the one that applies.
The provider and contracting party is: KILUK Peptides, [ENTER BUSINESS ADDRESS]. VAT details and contact information are set out in the legal notice (Impressum).
The shop is aimed at customers with a delivery and billing address in Germany and in the other member states of the European Union.
Deviating, conflicting or supplementary terms of the customer do not become part of the contract unless the provider expressly agrees to their validity in text form (Textform). This also applies if the provider delivers while aware of such terms.
A consumer within the meaning of these terms is any natural person who concludes the contract for purposes that are predominantly outside their commercial or self-employed professional activity. An entrepreneur is any person who, when concluding the contract, is acting in the exercise of a commercial or self-employed professional activity.
2. Conclusion of contract
The presentation of the products in the shop is not a legally binding offer. It is a non-binding invitation to the customer to submit an offer of their own.
Items marked "in preparation" in the catalogue cannot be ordered. No contract is concluded for them.
By submitting the order via the button that completes the ordering process, the customer submits a binding offer to conclude a purchase contract for the items in the shopping cart. Before submitting, the customer can review and change their entries using the usual keyboard and mouse functions and the correction options provided during the ordering process.
After the order is received, the provider sends an automatic confirmation of receipt by email. This confirmation merely documents that the order has arrived and does not yet constitute acceptance of the offer.
The contract is concluded as soon as the provider expressly declares acceptance of the order in text form or dispatches the ordered goods. If neither a declaration of acceptance nor a dispatch takes place within seven calendar days of receipt of the order, the customer's offer is deemed to have been rejected.
The provider reserves the right to reject an order in whole or in part without giving reasons. Grounds for rejection may exist in particular where there are justified doubts about use as intended, where the minimum age is not credible, where the delivery address lies outside the shipping area under clause 5, where delivery is legally impermissible at the destination, where the goods are unavailable, or where there is an obvious pricing or presentation error. In such a case, payments already made are refunded promptly and in full.
The text of the contract is stored by the provider and sent to the customer in text form together with these terms. The contract language is German.
3. Use as intended and responsibility of the buyer
All products offered in the shop are research chemicals. They are intended exclusively for use in laboratory, educational and research contexts.
The products are expressly not intended for human or animal consumption, for application on or in the human or animal body, for medical, therapeutic, pharmaceutical, diagnostic or cosmetic purposes, for use as food, food supplements, feed or medicinal products, or for any form of transfer for such purposes.
The products are not approved medicinal products and have not undergone any official approval or authorisation procedure for application to humans or animals. The provider gives no usage recommendations, no dosage information and no instructions on preparation for any application, and will not provide such information on request either.
Sold exclusively to persons aged 18 or over for use in laboratory, educational and research settings. By submitting the order, the customer bindingly confirms that they have reached the age of 18, that they will use the products exclusively for the permissible purposes named above, and that they will neither apply them themselves nor pass them to third parties for application.
The customer is obliged to store the products securely and out of the reach of unauthorised persons, in particular children, to observe general laboratory hygiene, to document the whereabouts of the goods and to comply with the applicable rules on occupational safety, hazardous substances and disposal.
If the customer passes the products on to third parties, they must pass on this restriction of purpose and the usage restrictions in full. If the customer breaches the obligations under this clause, they alone bear the resulting consequences; the provider is not liable for damage arising from use other than as intended.
4. Prices and payment
All prices stated in the shop are final prices in euros and include statutory VAT; for deliveries within Germany this is currently 19 percent. Shipping costs are not included; they are shown separately during the ordering process and displayed as a total amount before the order is submitted.
For goods offered by weight or volume, the unit price in the quantity unit required under the German Price Indication Ordinance (Preisangabenverordnung) is stated alongside the final price.
Payment is made exclusively in advance by SEPA bank transfer to the account named in the order confirmation. Other payment methods are available only if they are expressly offered during the ordering process.
The customer is obliged to state the order number provided to them as the payment reference. Without a clear allocation, processing may be delayed; the provider is not liable for delays caused by a missing or incorrect payment reference.
Dispatch takes place only once the invoice amount including shipping costs has been received in full in the provider's account. Partial payments do not lead to partial delivery unless agreed otherwise.
The invoice amount is due for payment within seven calendar days of the order. If no payment is received by then, the order is cancelled; in this case the provider is entitled to withdraw from the contract. An amount received after that point is transferred back unless expressly agreed otherwise.
Fees incurred through payment processing at the customer's bank or at intermediary institutions are borne by the customer. The fee option must be chosen so that the full invoice amount reaches the provider.
The customer may offset only claims that are undisputed or have been established by a final court decision. A right of retention is available to them only insofar as their counterclaim arises from the same contractual relationship.
Invoices are provided in electronic form as PDF. The customer agrees to electronic invoicing.
5. Shipping and delivery
Shipping takes place to Germany and to the other member states of the European Union. The provider does not ship to third countries.
Shipping is in neutral packaging that allows no conclusions about the contents. The goods are packed so that they are sufficiently protected for transport.
The lyophilisates offered are stable at ambient temperature over the shipping period. Shipping takes place without a cold chain, with short transit times.
Information on delivery times is a non-binding estimate unless a binding delivery date has been expressly agreed in text form. After receipt of payment, delivery within Germany usually takes one to three working days, and three to seven working days to the other EU member states.
If an ordered product becomes permanently unavailable after the contract is concluded, the provider informs the customer without delay and refunds payments already made for the affected part of the order.
Towards consumers, the risk of accidental loss and accidental deterioration of the goods passes only upon handover to the consumer or to a person designated by them. If the consumer has commissioned the carrier themselves without the provider having named that carrier, the risk passes upon handover to the carrier.
Towards entrepreneurs, the risk passes upon handover of the goods to the transport company.
The provider is not liable for delays caused by circumstances within the responsibility of the transport company or other third parties, or for delays caused by force majeure. In these cases, the delivery periods are extended accordingly.
6. Right of withdrawal for consumers
Consumers have the statutory right of withdrawal (Widerrufsrecht) for distance contracts. Consumers may withdraw from the contract within fourteen days without giving reasons. The period begins as soon as the consumer, or a third party named by them who is not the carrier, has taken possession of the goods.
The details of exercising the right of withdrawal, of the periods, of the legal consequences and of returning the goods are set out in the withdrawal policy (Widerrufsbelehrung), which is available in the shop as a separate document and is sent to the consumer in text form together with the order confirmation. The withdrawal policy forms part of these terms; a model withdrawal form is attached to it.
An exception applies in the case governed by section 312g(2) no. 3 of the German Civil Code (§ 312g Absatz 2 Nummer 3 BGB): in the case of sealed vials, the right of withdrawal lapses if the seal has been removed after delivery, because such goods are not suitable for return for reasons of health protection and hygiene. As long as the seal is intact, the right of withdrawal applies without restriction.
No exclusion of the right of withdrawal for the product range going beyond this, and no blanket exclusion, takes place.
In the event of an effective withdrawal, the provider refunds all payments received, including the costs of standard delivery, in accordance with the withdrawal policy. The consumer bears the direct costs of the return unless the withdrawal policy provides otherwise. The consumer is liable for any diminished value of the goods only if that diminished value results from handling other than what was necessary to establish the nature, characteristics and functioning of the goods.
7. Warranty and complaints
Statutory liability for defects applies. The provider is liable for ensuring that the goods have the agreed quality when the risk passes and correspond to the product description.
No quality going beyond this information and no suitability for a particular purpose is warranted unless expressly agreed in text form.
No documentation beyond the product description is linked on the product page or enclosed with the delivery.
The customer must check the goods for completeness, obvious defects and transport damage immediately after receipt. Recognisable transport damage should, where possible, be documented with the delivery agent and reported to the provider without delay, at the latest within fourteen days of receipt, together with meaningful photographs of the packaging and the contents. For consumers, this notification is not a precondition for asserting their statutory rights, but it does make handling matters with the transport company easier.
For entrepreneurs, the commercial duty to examine the goods and give notice of defects under section 377 of the German Commercial Code (§ 377 HGB) applies. Obvious defects must be notified in text form without delay, hidden defects without delay after their discovery.
The limitation period for claims based on defects is two years from delivery for consumers in the case of new goods. For entrepreneurs it is one year from delivery; this does not affect claims based on fraudulently concealed defects, claims under a guarantee, or claims for damage arising from injury to life, body or health and for other damage based on intent or gross negligence.
There are no claims based on defects insofar as a defect results from improper storage, handling or further processing by the customer, or from use other than as intended.
The provider assumes a guarantee in the legal sense only if it is expressly designated as such and granted in text form.
8. Limitation of liability
The provider is liable without limitation for damage arising from injury to life, body or health that is based on an intentional or negligent breach of duty by the provider, its legal representatives or its vicarious agents.
The provider is likewise liable without limitation for damage based on intent or gross negligence, for fraudulently concealed defects, to the extent of an expressly assumed guarantee, and under the mandatory provisions of the German Product Liability Act (Produkthaftungsgesetz).
In the case of a slightly negligent breach of a material contractual obligation, the provider's liability is limited in amount to the damage that was foreseeable at the time the contract was concluded and is typical for this type of contract. Material contractual obligations are those obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the contracting party may regularly rely.
In all other respects, the provider's liability is excluded. This applies in particular to slightly negligent breaches of non-material contractual obligations.
The above limitations of liability also apply for the benefit of the provider's legal representatives, employees and vicarious agents.
The provider is not liable for damage arising from the customer using the products contrary to clause 3, and in particular not for damage arising from application to humans or animals. The customer indemnifies the provider against claims by third parties that are based on such use by the customer contrary to the intended purpose; this does not apply insofar as the provider is itself at fault.
9. Data protection
The provider processes the customer's personal data exclusively within the framework of the applicable data protection law, in particular the General Data Protection Regulation (Datenschutz-Grundverordnung) and the German Federal Data Protection Act (Bundesdatenschutzgesetz).
Which data are processed for which purposes and on which legal basis, how long they are stored, to which recipients they may be passed on, and which rights the customer has, are set out in the privacy policy (Datenschutzerklärung). It is available via the shop at any time and is not part of these terms.
The data required to process the order are transmitted to the shipping company commissioned.
10. Legal responsibility of the buyer
The customer alone is responsible for ensuring that the acquisition, possession, storage, use and disposal of the products ordered are legally permissible at their place of residence and at the destination.
The legal classification of research chemicals differs between the member states of the European Union and changes continuously. The provider does not check, and cannot check, which rules apply at the customer's location. Information in the shop does not constitute legal advice.
Before each order, the customer must inform themselves independently about the applicable rules. If in doubt, they should refrain from ordering.
If the customer orders a product whose possession or movement is not permissible at their location, they alone bear the resulting disadvantages. There is no claim to a replacement delivery or to reimbursement of storage or destruction costs.
The provider is entitled to reject orders from member states in which, to its knowledge, the products offered may not be placed on the market.
11. Changes to these terms
The provider reserves the right to amend these terms with effect for the future, in particular in order to adapt them to changes in the law, to case law, or to changes in its own range of products.
For a contract already concluded, the version that was available in the shop at the time of the order and was sent to the customer in text form always applies. No subsequent unilateral change to ongoing contracts takes place.
The current version is available in the shop and carries a date of amendment. The customer should read it before each order.
12. Applicable law, dispute resolution, final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Towards consumers, this choice of law applies only insofar as it does not withdraw the protection granted by mandatory provisions of the law of the state in which the consumer has their habitual residence.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from the contractual relationship is the provider's registered office. The provider remains entitled to bring proceedings at the customer's general place of jurisdiction as well. Towards consumers, the statutory places of jurisdiction apply.
The European Commission's online dispute resolution platform was discontinued on 20 July 2025; a link is therefore no longer provided. You can address complaints directly to kontakt@kiluk-peptides.com.
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle).
Should a provision of these terms be or become wholly or partly invalid or unenforceable, the validity of the remaining provisions remains unaffected. The statutory provisions take the place of the invalid or unenforceable provision.
Amendments and additions to the contract require text form. This also applies to the waiver of this form requirement.
